Jurisprudential foundations of "dignity", "wisdom" and "interest" in the international interactions of the Islamic State

Abstract

The mandatory triangle of honor, wisdom and expediency as the framework and policy governing the international relations of the Islamic State is one of the issues discussed in political jurisprudence, and despite many emphasis on it, the jurisprudential foundations of these standards and the explanation of their relationship to each other are not very clear; Due to the fact that no extensive and integrated research has been done in this regard! Therefore, the question of the jurisprudential foundations of the standards of honor, wisdom and expediency and their relationship with each other in the international relations of the Islamic State is an issue that needs to be followed up to the stage of a suitable answer. Relying on the analysis derived from the judgment of reason and in the light of the revelation teachings, the mentioned standards are proved as the most basic principles and criteria in the field of international interactions, after the theoretical and epistemological foundations. The importance and position of the principle of honor indicates its stability at the top of the pyramid and based on the two principles of wisdom and expediency. This research was done with the aim of knowing the limits and gaps of the evidence and explaining and analyzing the jurisprudential foundations of honor, wisdom and expediency and its scope of evidence, and achieving this goal in the shadow of the description and analysis of jurisprudential propositions is possible by collecting library data, the result of which is the analysis of documents. The jurisprudence of the mentioned measures and the explanation of their relation to each other.

يعتبر مثلث الشرف والحكمة والمنفعة الإلزامي كإطار وسياسة تحكم العلاقات الدولية للدولة الإسلامية من المسائل التي يناقشها الفقه السياسي، ورغم التأكيد الكثير عليه، إلا أن الأسس الفقهية لهذه المعايير وشرحها العلاقة مع بعضها البعض ليست واضحة جدا؛ نظراً لعدم إجراء أي بحث شامل ومتكامل في هذا الصدد! ولذلك فإن مسألة الأسس الفقهية لمعايير الشرف والحكمة والمنفعة وعلاقتها ببعضها البعض في العلاقات الدولية للدولة الإسلامية هي مسألة تحتاج إلى متابعة حتى مرحلة الإجابة المناسبة. وبالاعتماد على التحليل المستمد من حكم العقل، وفي ضوء تعاليم الوحي، ثبت أن المعايير المذكورة هي أهم المبادئ والمعايير الأساسية في مجال التفاعلات الدولية، بعد الأسس النظرية والمعرفية. إن أهمية مبدأ الشرف ومكانته تشير إلى ثباته في أعلى الهرم وقيامه على مبدأي الحكمة والمنفعة. تم هذا البحث بهدف معرفة حدود الأدلة وثغراتها وشرح وتحليل الأسس الفقهية للشرف والحكمة والمنفعة ونطاق أدلتها، وتحقيق هذا الهدف في ظل وصف وتحليل الطروحات الفقهية. وذلك من خلال جمع البيانات المكتبية، والنتيجة هي تحليل الوثائق، وفقه التدابير المذكورة وبيان علاقتها ببعضها البعض.
